Ividiyo Mobile — Terms of Use

1. Acceptance
These Terms of Use ("Terms") govern your use of the Ividiyo Mobile application for iOS and Android ("the App"), published by AD Infratech (Pty) Ltd ("AD Infratech", "we", "us"), a company registered in the Republic of South Africa. By installing or using the App you agree to these Terms.
The App is a companion to the Ividiyo video management system. Your use of the Ividiyo software, cloud services, and licences is additionally governed by the Ividiyo Terms of Service at ividiyo.com/terms. If these Terms conflict with the Ividiyo Terms of Service, the latter prevails for the underlying service.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for the purpose of accessing an Ividiyo system you are authorised to access.
You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except to the extent permitted by applicable law.
Where the App is distributed through the Apple App Store or Google Play, the store's standard licence terms also apply; in case of conflict regarding distribution, the store's terms prevail.
3. Accounts and Subscriptions
The App does not create accounts. You sign in with an existing Ividiyo Cloud account or with credentials for your own Ividiyo server. Accounts, licences, and subscriptions are created and managed on the Ividiyo Cloud portal, not in the App, and the App contains no in-app purchases.
Mobile access is a feature of paid Ividiyo plans. If your plan or licence lapses, the App may refuse sign-in until it is renewed.
You are responsible for keeping your credentials secure and for all activity under your account. Remote-access devices can be reviewed and removed on the Ividiyo Cloud portal.
4. Lawful Use of Video Surveillance
Ividiyo is a tool for viewing camera systems that you own or are authorised to access. You are solely responsible for ensuring that your cameras, recordings, and use of the App comply with all laws that apply to you — including privacy, data-protection (e.g. POPIA, GDPR), workplace, and surveillance laws in your jurisdiction, and any requirements for signage, consent, or notification.
You may not use the App to access any camera system without authorisation, or for any unlawful purpose. We may terminate access for breach of this section.
5. Service Availability
Remote viewing depends on your own server, your internet connections, and — when a direct connection is not possible — our relay infrastructure. We aim for high availability of our cloud and relay services but do not guarantee uninterrupted access. Remote-viewing bandwidth through our relays is subject to the fair-use allowances of your plan.
The App and the Ividiyo system are not a life-safety or emergency service. Do not rely on them as the sole means of protecting persons or property; alarm response and emergency escalation remain your responsibility.
6. Updates and Changes
We may update the App from time to time to add features, maintain compatibility, or fix issues. Some updates may be required for continued use. We may modify or discontinue features of the App with reasonable notice where practical.
7. Privacy
Our handling of personal information in connection with the App is described in the Ividiyo Mobile Privacy Policy at adinfratech.co.za/ividiyo/privacy. Your camera footage stays on your own servers and is not stored by us.
8. Disclaimer and Limitation of Liability
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, AD Infratech shall not be liable for any indirect, incidental, special, or consequential damages — including loss of recordings, missed events or notifications, property loss, or business interruption — arising from the use of or inability to use the App.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including applicable provisions of the South African Consumer Protection Act.
9. Termination
You may stop using the App at any time; uninstalling it removes locally stored App data. We may suspend or terminate your access to our cloud and relay services for material breach of these Terms. Sections 4, 8, and 10 survive termination.
10. Governing Law and Contact
These Terms are governed by the laws of the Republic of South Africa, and disputes are subject to the jurisdiction of the South African courts.
